1. General.

  1. AzZumur IT Design reserves the right to change these terms and conditions at any time.
  2. AzZumur IT Design may be referred to as 'the Company', 'us' or 'we' in the following Terms & Conditions
  3. A customer who has purchased a product may be referred to as 'the Customer' or 'you' in the following Terms & Conditions.
  4. These Terms & Conditions constitute the entire agreement between the parties and supersede any other agreement, proposals and communications, written or oral, between the Company representatives and the Customer.
  5. Only basic support and advice services by email will be provided to customers if required. Telephone support and on-site training are not included. If the Company agrees to provide such services they may be subject to additional terms and payment.
  6. The Company has no obligation to provide phone support or other additional support services to the Customer.
  7. AzZumur IT Design is not responsible for the content of any customer web pages. The views expressed on any Customer's web pages are the responsibility of the Customer and not the responsibility of AzZumur IT Design.
  8. AzZumur IT Design reserves the right to inspect all Customer web pages for material which, at the sole discretion of the Company is considered to be objectionable, offensive or in any way undesirable.

2. Project Work.

  1. The customer is to provide all content and graphics in the required digital format to AzZumur IT Design before work starts on a project.
  2. The content and graphics must be supplied via floppy disk, CD or email.
  3. Work will be completed subject to the information supplied by the client.
  4. The customer will be allowed to inspect and verify the website/application before ‘hand over’ and any minor modifications will be made once within a specified time according to the requirements specification.
  5. If any further changes to the solution are required then the customer must inform AzZumur IT Design within 5 working days in writing from the project start date. The invoice will be amended to reflect any changes. Otherwise all work will be charged extra as a separate project.
  6. AzZumur IT Design will not guarantee an exact time for completion of work due to any technical issues that may arise. We try our level best to deliver all our projects on time to our clients and put all our effort in doing so.
  7. Once work has started and the client decides to terminate the agreement or cancel the project, the client is required to pay any outstanding amount for all the work done during the specified period. All data supplied by the client will be given back to the client. No work carried out on the client's project will be given to the client. The only exception will be domain names that are registered to the client.
  8. Should the customer wish to transfer the domain name to another ISP, 10 days notice must be provided in writing to AzZumur IT Design. A £15 administration fee will be incurred.
  9. All project work will include a link back to AzZumur IT Design from the client website or application and will include acknowledgment of design work by the company.

3. Price and Payment.

  1. All prices quoted are subject to changes anytime and exclude VAT.
  2. Extra charges will apply if the customer requires any extra graphics,logo or banner designed and if extra features are required as defined in the CustomiseWeb package.
  3. All setup and administration charges for web hosting, email account management and domain name registration will be incurred per annum or except where otherwise stated.This is a standard requirement in order for your website to remain online and to keep your domain name and email account.
  4. Work will commence after 50% of the total amount has been paid and cleared and all data (content and graphics) has been supplied by the customer.
  5. After the work has been completed the outstanding balance of 50% will need to be paid and cleared before the website/application is 'handed over' to the customer and the website/application goes online/live.
  6. All deposits are non refundable.
  7. Once work has started and the client decides to terminate the agreement or cancel the project, the client is required to pay any outstanding amount for all the work done during the specified period.
  8. All payments must be made within 7 days from the date of the invoice.
  9. If the customer fails to make any payment on the date it is due, we can cancel this agreement between you (the customer) and us; or suspend any further work; and/or charge you interest as specified below.
  10. For any late payments interest will be charged per day at a rate of 2%.

4. Customer Account.

  1. A customer account is available to any customer who has requested work to be undertaken and has registered all required information, provided an accurate, legitimate electronic mail address, and obtained a unique AzZumur IT Design Username and password.
  2. AzZumur IT Design does not discriminate on the basis of age, gender, or ethnicity. Each Customer is allowed to have only one Customer account with the privileges associated with the account.

5. Copyrighted Material.

  1. All material on the Company Site, including text, software, photos, video, graphics, music and sound, are protected by British and international copyright laws, both as individual works and as a collection.
  2. It is the responsibilty of the customer to ensure that no material protected by copyright may be placed on any Customer site/application without the permission of the author or owner of the copyright on that material.
  3. If AzZumur IT Design becomes aware of the presence of copyright infringing material on Customer websites either through the course of normal business activities, or through notification by a third-party the Company will contact the concerned Customer and alert him or her of the allegations of copyright infringement. The Customer must respond within five days explaining why the allegedly infringing material does not constitute infringement of copyright. The Company reserves the right to delete or remove the page if the Customer fails to respond within five days. If the Customer does respond and claims the page is not infringing, the Company may either forward the response to the third party alleging the infringement, or remove the page or both.
